1. License Grant
The Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device that you own or control, subject to the Usage Rules set forth in the Apple Media Services Terms and Conditions.
2. Description of the App
My Live Translator and Tutor is a language learning and real-time translation application that connects to third-party AI services (OpenAI and Google Gemini) using API keys that you provide. The App facilitates real-time audio translation and interactive language tutoring.
3. Third-Party Services
The App requires you to provide your own API keys for OpenAI and/or Google Gemini. Your use of these services is governed by their respective terms of service and privacy policies. The Developer is not responsible for the availability, performance, or policies of these third-party services.
You are solely responsible for any costs incurred through your use of third-party API services. The Developer does not charge for API usage and has no control over third-party pricing.
4. User Responsibilities
You agree to:
- Provide and manage your own API keys responsibly
- Keep your API keys confidential and secure
- Comply with the terms of service of any third-party AI provider you use
- Use the App in compliance with all applicable laws and regulations
- Not use the App for any unlawful, harmful, or abusive purpose
5. Intellectual Property
The App and all related content, features, and functionality are owned by the Developer and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App.
6. Privacy
Your use of the App is also governed by our Privacy Policy, which describes how the App handles your data. The App is designed with a privacy-first architecture: conversation data is transmitted directly between your device and your chosen AI provider.
7. Disclaimers
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. The Developer does not warrant that the App will be uninterrupted, error-free, or free of harmful components.
Translations and tutoring responses are generated by third-party AI systems and may contain errors. The App should not be relied upon for critical translations in medical, legal, or emergency situations.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits, arising from your use of the App or third-party services.
9. Termination
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies from your devices.
10. Apple-Specific Terms
This Agreement is between you and the Developer only, and not with Apple Inc. Apple has no obligation to furnish any maintenance and support services with respect to the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. Apple has no other warranty obligation with respect to the App.
Apple is not responsible for addressing any claims relating to the App or your use of the App, including product liability claims, consumer protection claims, or intellectual property infringement claims.
Apple and its subsidiaries are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Apple will have the right to enforce this Agreement against you as a third-party beneficiary.
11. Changes to This Agreement
The Developer reserves the right to modify this Agreement at any time. Changes will be posted on this page with an updated revision date. Continued use of the App after changes constitutes acceptance of the modified Agreement.
